The Right Track


The decision to create a freight super-railway through inland Florida represents a 100-year decision in the heritage of many small-town communities. Because the CSX deal was struck in secret, citizens never got a say about the state’s transportation future. The CSX deal may be the worst deal ever negotiated on behalf of citizens. It should be reconsidered.


Good Idea, Wrong Route

The 2009 Florida Legislature is expected to address the CSX deal in its opening weeks. Lawmakers will be asked to approve the liability provision – the last domino for setting the deal in motion – though they’ve never been heard on the project’s costs or feasibility. Because of the deal’s many problems, here’s what should happen:

  1. Gov. Charlie Crist should tell lawmakers and citizens that upon closer review, he cannot sign the CSX deal because it creates bad precedent and the state cannot afford it. He should then create a credible mechanism for developing a transportation plan that sets aggressive deadlines for improving the movement of people around Florida by rail, including commuters through urban regions.


  2. Like Massachusetts, the Florida Legislature should refuse to indemnify a for-profit freight railroad that leases time on state-owned commuter tracks. Furthermore, lawmakers should follow California’s lead and prohibit government bodies from indemnifying the wrongdoing of private companies.


  3. The Legislature should audit funds dedicated to SunRail, with a special emphasis on the money appropriated by the 2005 growth management law, the delaying of road projects elsewhere in the state, and the influence of railroad executives in determining how taxpayer money got redirected.


  4. Before applying for state funds to support commuter rail, urban communities should be required to have a dedicated local funding source. In the case of Tri-rail, lawmakers should stop playing politics and allow the agency to ask citizens for a needed new revenue source.


  5. CSX’s proposed freight super-railway through inland Florida should be rerouted to prevent life-changing disruptions to the state’s smaller towns and cities. And an independent analyst (not involved in negotiating the deal) should re-assess the economic assumptions of the rail-and-truck hub in Winter Haven.

Did you know that 23,000,000 taxpayer dollars have been promised to the CSX Corporation for the relocation of the Taft railyard to Southeast Winter Haven? The residents of Sundance Ranch Estates have been promised $0 in the freight deal to compensate them for their absolutely certain drastic loss in property values. When discussing the inequites of the chosen location adjacent to Sundance Ranch, CSX, government officials, and legislative leaders have attempted to placate us with "Sometimes these things happen". Oh yeah, and my favorite quote is, "Sometimes life isn't fair". Contrast those patronizing diddies with this CSX spokesman Gary Sease quote: " As a private company, we don't just give up private assets without compensation. Our stockholders wouldn't appreciate that."

According to The Ledger, the offer was made to a Sharon Kiser. The newspaper stated that both Senator JD Alexander and Senator Paula Dockery supported using some of the money budgeted to move the Taft railyard to Winter Haven to buy out Sundance homeowners. One thing people must realize about Sundance: These people live on unpaved roads. The only road leading into and out of Sundance is unpaved. So these people built their homes on dirt roads, by a railroad track and across from a sewage plant. Compared to that, a railyard would INCREASE their property values.

I was in that meeting to which you refer an offer was made. There was no such offer made then or since. The article doesn’t even say there was an offer made. Even though the article misquotes the actual discussion, the article never states that JD Alexander said he was going to ask that some of the money allocated for moving the rail yard from Taft be used for buying Sundance. And he didn’t say that in the meeting either. Your facts are lies. Paula Dockery said, in that meeting, that Sundance does need to be bought, and since there is so much taxpayer money going to CSX, they should have to buy Sundance—but not with taxpayer monies. So again your facts are lies. Actually, Sundance property was holding its own in value much better than other areas of Winter Haven because it’s unique with 5-acre wooded lots so close to Cypress Gardens. It’s when the CSX Industrial facility was announced that Sundance lost property value—and that has been directly attributed to CSX by appraisers. How can you begrudge taxpaying residents the need to move away from an industrial site and hold onto their property values for their future? Are you willing to give up everything—including your sleep--while that industrial facility grinds away all night? By the way, there is not a sewage treatment plant next to, beside, or near Sundance Ranch Estates. And, again, your facts are lies. Skidmore and Eloise Point, to name two, are closer to the sewage plant. According to your reasoning, those properties should have been avoided. And should we start naming the developments in Winter Haven near or on railroad tracks?

Whether it's David Dickey (and it does sound just like something he would say) belittling someone's home like that is totally uncalled for--and must be from someone in bed with CSX and on the take themselves. Why else would someone be so mean? I would love to live in the peace, quiet, and tranquility of Sundance. My neighborhood, although nice, is built with the homes so close and surrounded by busy roads. Even though it's a walled developement, the road noise gets pretty intense sometimes. But with the ILC coming, all the things that are wonderful about Sundance will be gone. I'd wager everything I have, that the mean blogger wouldn't want to live next to that ILC. He'd be screaming loud and with venom when he lost his property values and serene way of life. Mean blogger, you've shown your hand--and it's dirty. Janice G.

I don't know David Dickey, but I was appalled by the horrid blogging about Sundance I read yesterday. I couldn't believe someone would be so cruel. Thank you, Jancie G. for standing up for decency. I thought the same thing that you said that whoever would be so mean must have ulterior motives and probably lining his own pocket with CSX money. I attended a baby shower in Sundance about 6 months ago. It was my first time to drive into that unique community. I didn't know the person giving the shower, but driving in, I was enthralled by the quiet and rural atmosphere. It was so peaceful and different than the typical subdivision. It was an afternoon party, and standing out in the beautiful yard, I couldn't take my eyes off the open land, the green fields, the horses in beautifully manicured pastures, and the friendly neighbors who waved as they drove by. What the mean blogger, as you called him, had to say about Sundance is just all wrong. Thanks again, Janice G. Here's what I don't understand. What if a development is not as upscale as the blogger with his nose-in-the-air seems to think is important? If it's people's homes and they are losing everything because of bad judgment from the city to allow an industrial faculty to be built next to them, why shouldn't they fight for their right to survive? Who is this person who thinks he's so highly evolved that he is the judge of how people should live and who should and shouldn't be snuffed out by big business and corrupt government? Since when is it a crime to live on dirt roads? Although, as in other instances, the blogger with the erroneous sense of his own judgement is wrong--inside the development of Sundance, there are no dirt roads.

The community of Florence Villa is filled with hard working, tax payers; the same as Sundance. I pray that they never have to commit the time and resources that has been thrust upon the Sundance Ranch Estates residents. No one would take on this David vs. Goliath battle unless they were in a desperate struggle to save their homes and their futures. But, if I were employed, appointed, or elected to serve the citizens; I would NOT disrespect their property rights and values. I certainly would not attempt to diminish their concerns, discredit their statements, or blatantly set myself up to prosper at their demise.

You are so right! Now visitor 10:50 is trying to make this a racial issue. What sort of convoluted reasoning is this? It doesn’t even make sense. The issues are that property values plummet with an industrial facility next to residential, people can’t sleep with all the racket, and the way of life they invested in will be gone—and that’s just the beginning of what’s at stake. With visitor 10:50’s inept, ridiculous reasoning skills, he’d be a cinch for a 6-year-old to whip in a debate. He’s all over the road with things that aren’t pertinent or are absolute lies. However, it does give us a really good look into his lack of logic proficiency. What would his response be if this monster industrial facility were being built in his backyard? What would he do if his property values were plunging because of CSX? What would he do if his family’s future were being stolen from him? If he says, he’d be happy and not fight it, then he’s more of an idiot than he’s already displayed. Or maybe he’s on the take with CSX and the city and thinks they wouldn’t put it in his backyard. He’d better consider this: If the city of WH will do it to Sundance in order for them to profit, they’ll do it to him or anyone else when the next project comes along.

You have evidently not visited Sundance Ranch Estates. The 35 5 acre lots are built on a dirt road because the residents CHOSE to live on a dirt road because they CHOSE to live in a RURAL residential community. Next to railroad tracks, yes, (just as those on Lake Eloise in their million dollar homes chose to do. Next to a 1200 acre spray field, yes (not a sewage plant as you say). How does lighting the night sky with 60 to 100 foot light poles with 6-12 1,000 watt bulbs on each pole (24 hours a day), incessently hearing "beep, beep, beep" from operating equipment, "bang, crash, boom" of loading and offloading rail cars, incessent running of diesel fumes, and 60 foot cranes play into increasing the property values. The Ledger said that Alexander and Dockery offered to help. It doesn't say they have. It also doesn't say ANY money has been promised or appropriated for such "buyouts". Get the facts straight or shut up.

Yes, the Sundance neighborhood is at the end of an unpaved road. Incidentally, we have been promised a paved road by the county for many years. The road was a small price to pay to traverse the short bumpy distance to arrive at our homes. Our property is large tracts of land, suitable for equine and other rural activities, in a historically good investment area of Southeast Winter Haven. The unpaved road, we could live with that. Our neighborhood is bordered on the West by a train track on which a brief, somewhat seldom, train passes. This actually lends itself to the rural atmosphere of a train passing in the country. The passing trains on the track, we could live with that. The city owned property to the west of the track was used as a spray field to return the clean, treated water to the aquifer. The sewage treatment plant is further from our homes than it is to the homes on the south side of Lake Eloise and Lake Winterset. For the uneducated, such as yourself, those are pretty good pieces of real estate. The spray fields, we could live with them. The property owners in Sundance Ranch Estates deserve to be respected. We are all highly contributing members of the community, and pay a lot of the taxes that are being spent on this freight deal. The proposed ILC is a 24 hour a day and 7 day a week heavy industrial facility which is an incompatible nuisance to residential homes and will cause serious financial injury. The CSX ILC, we cannot live with that.

One of the biggest problems of this whole deal is all the misinformation being put out there by FDOT and business interests that stand to gain by this debacle. Six hundred million of taxpayer's money being spent to benefit CSX is an outrage. Anytime there is a government give away this big, corruption starts to run rampant. I have to wonder how many palms have been greased and how many promises of big paying jobs have been made. Suddenly we have a bunch of politicians changing their positions on this thing. This infection has even come to Volusia County where the Council has reversed their prior decision not to participate. I'm quite sure a lot of political pressure was put on these inept people by the likes of Mica, Dyer, and probably Crist, not to mention the business alliance that is also pushing for this thing. I'm hoping that no payola has come to my County, but it wouldn't surprise me. FDOT and CSX are definitely in bed together, and now it is starting to look like an orgy.

#25 Commuter rail passes first hurdle

Orlando's commuter rail system passed its first hurdle in the Florida House today. The House Economic Development and Community Affairs Council cleared it on a 14-3 vote. It's interesting to note that the person who runs this website testified against the project. This is the same lady who earlier said she started this website as a concerned citizen and was not being paid for it. Later, in an interview with a Lakeland blog, she admitted she got her information while on the payroll of the Lakeland Downtown Development Authority. Now, we're expected to believe that she went to Tallahassee on her own dime? People on this website are always accusing CSX of negogiating this deal behind closed doors in smoke-filled rooms. How about a little sunshine from this blog? Also, this blog earlier reported that Plant City Representative Richard Glorioso "is telling people he cannot support the CSX deal". The entry did not quote Mr. Glorioso nor did the entry state where this website got the story. No wonder. The story was false. Mr. Glorioso was one of the 14 committee members who voted in FAVOR of the project. The 3 who voted against it were from Baker, DelRay Beach and Miami Gardens.

Dear Visitor,

You're right. I testified in the House yesterday about the $2.66 billion Train To Nowhere.

I find it immensely interesting that Tallahassee cannot grasp the concept of a citizen - in this case, a laid-off journalist - testifying against corporate welfare and an open check on the public's purse.

But you're wrong. From the start, I have been proud to say that after I was laid off, I was briefly hired by the Lakeland Downtown Development Authority to continue to call out the terrible terms of the CSX deal, which among many things, would destroy a charming downtown. However, the small agency felt its funding threatened for having hired a public advocate. Such is the world of big-money politics.

I was asked this week, "Why you are doing this?" The short answer is that I wrote a lot about this issue while editor of The Tampa Tribune's editorial board and want to see it through. Perhaps I can find a sustainable future in giving voice to the voiceless, leveraging a career dedicated to doing exactly that. My friends and family tell me that if I continue to stand up for the side of right, the money will follow. I'm giving myself a year to see if it's true. Wish me luck.

For the record, I paid my own way to Tallahassee, rented a car after my car's radiator sprung a leak, then stayed with a friend, to whom I'll be forever grateful.

Now, will you ask the 100 lobbyists and 5 PR firms on the moneyed side of this issue to put their financials on the table?

Times are tough, and the full attention of our elected leaders should be given to economic recovery, transition and job growth. Last year, Gov. Charlie Crist announced his Accelerate Florida program to advance investment in infrastructure projects that will create jobs and encourage economic growth. The wisdom of the governor's initiative is evidenced by the strong return on investment generated by infrastructure projects. For example, for every dollar invested in transportation projects, $5.60 in economic benefit is gained. That is a smart investment. In addition to backing the Accelerate Florida initiative, the Florida Chamber of Commerce joined Gov. Crist in his call for national leaders to invest in our state's more than $7 billion in shovel-ready transportation projects that can be started in less than four months, delivering a quick return on investment. Along with those important projects, our state has even more work to do to prepare our transit infrastructure before we add another 7 million residents by the year 2030. Florida must continue to diversify and expand its mix of transit solutions to move goods and people. One significant transit solution Florida should build upon is the expansion of commuter rail. While commuter rail systems are being planned in several regions, the Central Florida region's proposed SunRail system provides the most immediate opportunity for construction activity that could leverage federal funding and quickly create thousands of jobs. The economic benefit of SunRail is not limited to Central Florida. As part of its agreement to purchase 61 miles of track for SunRail, the state will direct reinvestment of private money in roadways, railroads and other transportation facilities throughout Florida. In addition to an existing South Florida system, SunRail will also lay the foundation for passenger rail systems in other Florida regions desperate for multi-modal transportation solutions. Expanding commuter rail in Florida is a great opportunity to leverage federal funding, create thousands of jobs and gain economic benefits that accompany transportation improvements. Actions by this coming legislative session by the Florida Legislature and by Gov. Crist will enable the SunRail project to serve as a much-needed stimulus to our state's economy. Florida needs long-term thinking and short-term action. The time to act on commuter rail is now.
